4. Publication, Explanation, and Amendment of These Terms
We publish these Terms where you can readily read them — on the sign-up screen of the Service and on our website — and we obtain your agreement to them when you create an Account.
We may amend these Terms to the extent permitted by applicable law.
If we amend these Terms, we will give notice of the amended content and its effective date at least 14 days in advance in the app or by email. For amendments that are unfavourable to you or otherwise material, we will give notice at least 30 days in advance and obtain your agreement in the app.
Where we have clearly stated in that notice that failing to object by the effective date will be treated as acceptance, and you do not expressly object, you are deemed to have accepted the amended Terms.
You are free not to accept an amendment. If you do not accept it, you may terminate your Account.
5. Supplementary Rules
Matters not provided for in these Terms are governed by applicable law and by our other terms (the Privacy Policy, the Location-Based Services Terms, and in-app notices). For the use of personal location information, the Location-Based Services Terms prevail over these Terms.
Chapter 2 — The User Agreement
6. Formation of the Agreement
The agreement is formed when you accept these Terms and the Privacy Policy, apply to create an Account, and we accept that application.
We may refuse an application, or terminate the agreement afterwards, if you have used another person's identity, are under 14 (Section 7), were previously restricted for breaching these Terms, intend to abuse free trials or promotions, or if there is a technical impediment or another breach of law.
7. Users Under 14
The Service is not directed to children under 14, and we do not accept sign-ups from them. You confirm at sign-up that you are 14 or older.
Where the law of your country sets a higher age (for example 16 in some EU member states), that higher age applies.
If we learn that we have collected personal data from a child under the applicable age without the consent of a legal guardian, we will delete it and the Account without delay.
8. Account Care and Your Obligations
You are responsible for your Account and password and must not let anyone else use them.
Tell us immediately if you learn that your Account is being used by someone else.
You must not use the Service to harass, threaten, or abuse anyone; sell or commercially distribute methods to bypass the mandatory lock screen; create multiple accounts to abuse free-trial periods; reverse-engineer or decompile the Service or access it by automated means (except as applicable law allows); infringe intellectual property rights; or otherwise break the law.
Chapter 3 — The Service
9. What the Service Provides, and Plans
We provide alarms and reminders based on the times, places, and calendar events you configure, missions you choose in order to dismiss them, and AI-assisted suggestions related to those features.
The Service has a free plan and paid plans (more than one tier). The features included in each plan, usage limits, prices, and whether a free trial is offered and for how long are as shown on the in-app subscription screen and in the product information on the Apple App Store or Google Play. We deliberately do not list features in these Terms; if the in-app display and these Terms conflict, the in-app display governs.
Much of the Service depends on permissions you grant to your operating system (precise and background location, calendar, camera, microphone, notifications, display over other apps, and others). You may refuse or revoke any permission at any time in your device settings; the features that depend on it will then not work.
10. The Mandatory Lock Screen
The mandatory lock screen is a self-imposed accountability tool. It operates only if you switch it on and configure it yourself.
Android: we use the display-over-other-apps permission (SYSTEM_ALERT_WINDOW) to show a screen that discourages switching to other apps until you complete the task you set. Emergency calls remain available at all times, and you retain control of your device's system functions.
iOS: because of platform restrictions the mandatory lock screen operates in soft mode only. We cannot prevent you from leaving the app; we can only send notifications urging you to return. We do not guarantee enforcement on iOS, and if you purchase a plan on iOS you do so knowing this limitation.
You can disable the mandatory lock screen and every mission at any time in Settings. We do not make disabling difficult, charge you to disable it, or impose any monetary penalty for not completing a task.
11. Camera, Microphone, and Location Missions
The face/expression mission (camera) and voice mission (microphone) are optional and off by default. Face detection on camera frames runs on your device and the frames are discarded immediately; speech is converted to text by your operating system's speech service.
However, the intention-proof mission (photo) and the AI coach character photo transmit a photo you take or choose to an external AI provider for judging or generation. Both are also off by default and run only if you choose them.
Location-based alarms and geofencing require precise and background location. The use of personal location information is governed by the Location-Based Services Terms.
The categories, purposes, retention periods, and sub-processors for all of this are set out in the Privacy Policy.
12. AI Features
Suggestions, summaries, briefings, lock-screen cards, and mission judgments are produced automatically by an AI system. We do not review them for accuracy before you see them.
To handle your request we transmit, to the extent necessary, information you entered or the Service collected (place type, time, calendar event titles and times, recent task titles, and similar) to an external AI provider. What is transmitted and to whom is set out in the Privacy Policy.
AI usage limits vary by plan, and we may set and adjust reasonable limits to keep the Service stable and prevent abuse.
13. Availability, Changes, and Suspension
We aim to provide the Service continuously, but may suspend all or part of it for maintenance, replacement, failure, loss of connectivity, or changes to an operating system or third-party service.
We may change the Service. If we change a Paid Service in a way that is unfavourable to you, we will give 30 days' notice, and you may terminate and request a refund of the amount corresponding to the unused portion of your term.
If we discontinue the Service we will give at least 30 days' notice, and will refund paid users for the unused portion of their term in accordance with applicable law and the relevant store's policy.
Chapter 4 — Paid Services
14. Payment
Paid Services are purchased through the Apple App Store or Google Play. Payment, billing, and refunds follow each store's policy and the payment method you registered with that store. We never hold your card details.
Prices are those displayed by the store in your currency, and may vary by country, region, exchange rate, and tax.
15. Free Trial
Whether a free trial is offered, for which plan, and for how long is as shown in the store's product information.
If you do not cancel before the trial ends, a paid subscription begins at the displayed price. Cancel in your store's subscription settings.
A free trial is generally offered once per user, and we may restrict abusive repeat use such as creating multiple accounts.
16. Renewal, Cancellation, and Refunds
Subscriptions renew automatically under each store's policy unless you cancel. To avoid renewal, cancel at least 24 hours before the renewal date in your store's subscription settings.
Withdrawal and refunds are governed by each store's refund policy. We cannot cancel or refund a store purchase directly; you must request it from the store.
Section 16.2 does not limit any statutory right of withdrawal or refund you have under applicable consumer law. If a store refund is not granted and you wish to exercise a statutory right, contact support@cozysand.com and we will explain the procedure.
Deleting your Account does not cancel an active subscription. You must cancel that separately in the store.
17. Price Changes
We may change the price of a Paid Service. If we increase a price we will give 30 days' notice, and the increase applies from the next subscription period beginning after you have been informed. If you do not accept the increase, cancel before the next renewal date.
Chapter 5 — ⚠️ Limits of the Service and Your Undertakings
This chapter defines what you must not use the Service for. By using the Service you confirm that you have read and understood it.
18. Alarm and Notification Delivery Is Not Guaranteed
The Service schedules alarms and delivers notifications through your operating system. Delivery can therefore fail or be delayed for reasons outside our control, including:
battery-optimisation, "deep sleep", and power-saving settings applied by your device manufacturer; Android Doze and app-standby buckets
Do Not Disturb, silent/vibrate/volume settings, and changes to notification channel settings
permissions being revoked, or the app being force-stopped or swiped away from recents
the device being powered off, restarted, out of storage, or out of battery
operating-system updates, and changes to the clock or time zone
network failures and outages at third-party services such as push servers
You must not use the Service as your only alarm. For any wake-up or appointment that matters, you must also set an independent alarm.
19. AI-Generated Information May Be Wrong
Suggestions, briefings, lock-screen cards, mission judgments, and information about opening and closing hours, last-transit times, travel times, place names, floors, and nearby venues are estimates assembled from third-party map data and AI output. They may be inaccurate, incomplete, or out of date. Verify anything that matters at its original source before you act on it. Nothing in the Service is medical, legal, financial, or other professional advice.
20. Location, Floor, and Place Information Is Approximate
GPS accuracy varies greatly with the environment, and an indoor floor is inferred from barometric pressure and map data. Place identification depends on third-party datasets that may be incomplete or outdated. The Service may show the wrong place or the wrong floor.
21. Sleep Features Are Not a Medical Device
Sleep detection and sleep statistics are estimates derived from device sensors and your own input. They are not intended to diagnose, treat, cure, mitigate, or prevent any condition, are not a medical device, and are not a substitute for professional medical advice.
22. Third-Party Services
The Service relies on third parties for maps, places, weather, music, payments, and AI. Those services operate independently under their own terms. We are not responsible for their content, accuracy, or availability, and their interruption or change may limit parts of the Service.
23. Your Undertaking Not to Use the Service for Safety-Critical Purposes
You undertake not to use the Service for any purpose where a failed or delayed alarm or notification could cause harm to life, body, or property. For example:
timing of medication, or medical appointments and procedures
catching transport you cannot afford to miss
deciding to begin driving, operating machinery, or any other activity requiring alertness
any other safety-critical activity
You undertake not to act on the location, floor, place, opening-hours, or transit information the Service shows without verifying it.
If loss arises because you used the Service in breach of Sections 23.1 or 23.2, our liability for that loss is reduced or excluded to the extent permitted by applicable law. This does not apply to loss caused by our wilful misconduct or gross negligence.
Chapter 6 — Liability
24. Disclaimer of Warranties
To the extent permitted by applicable law, the Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted or error-free, that the mandatory lock screen will work on every device and OS version, or that AI suggestions will be accurate or suitable for your situation. This Section does not exclude any warranty or remedy that cannot be excluded under applicable law.
25. Limitation of Liability
To the extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service shall not exceed the amount you actually paid us for the Service in the three months immediately preceding the event giving rise to the claim.
To the extent permitted by applicable law, we are not liable for indirect, special, consequential, incidental, or punitive damages, or for lost profits, lost data, or lost opportunities.
We are not liable for loss caused by:
alarms or notifications failing or being delayed because of your device, operating system, or manufacturer settings (Section 18)
your refusing or revoking a permission, or force-stopping the app
the failure, change, or discontinuation of a third-party service (Section 22)
your breach of the undertakings in Section 23
your failure to keep your Account and password secure
Sections 25.1 to 25.3 do not apply to liability for our wilful misconduct or gross negligence, to death or personal injury, or to any liability that cannot be limited or excluded under applicable law. Nothing in these Terms limits the rights that mandatory consumer-protection law gives you in your country of residence.
26. Your Responsibility
If a third party brings a claim against us because you breached these Terms or used the Service unlawfully, you will indemnify us and hold us harmless against that claim and any resulting loss, except to the extent the loss is attributable to our own fault.
27. Force Majeure
We are not liable for failing to provide the Service because of events beyond our reasonable control, including natural disaster, war, epidemic, power failure, government order, interruption by a telecommunications carrier, or policy changes by an operating-system or app-store provider.
Chapter 7 — Miscellaneous
28. Intellectual Property
The Service and its components (software, design, trade marks, text, images, sounds) belong to us or to their rightful owners.
We grant you a non-transferable, non-exclusive licence to use the Service under these Terms. No intellectual property is transferred to you.
29. Your Content and Feedback
You own the content you enter into the Service (tasks, habits, places, and the like). You grant us permission to store, copy, and process that content only to the extent necessary to provide, maintain, and support the Service. That permission ends when you delete the content or your Account.
If you voluntarily send us opinions, suggestions, or ideas ("Feedback"), we may use them freely, without payment and without any obligation of confidentiality.
Content you share from the App. When you share or save something from the App — including a photo of your face kept by the optional Morning face photo feature, or a card made from it — you do so by your own choice and on your own responsibility, through your device's share sheet to the destination you pick, or to your own photo gallery. We do not receive that content, and once it has left your device we cannot delete or recall it. You must respect other people's rights: do not share a photo that shows another person, or that person's face, without their consent, and do not use shared content to harass, mislead, or impersonate anyone. Although the App blurs other faces it detects, detection can miss someone, so check the image before you share it.
30. Restriction and Termination
You may terminate at any time in the app (Settings → Delete Account) or on our deletion page. Your data will then be deleted in accordance with the Privacy Policy.
We may restrict use or terminate the agreement, after notice, if you breach these Terms or the law, abuse a free trial or promotion, or interfere with the operation of the Service. In urgent cases we may restrict first and notify afterwards.
You may object to any such measure at support@cozysand.com. If we consider the objection justified we will restore your access immediately.
31. Notices
We may notify you by in-app notice, push notification, or the email address on your Account. Notices to users generally may be given by in-app notice or by posting on our website.
32. Assignment
We may transfer our rights and obligations under these Terms to a successor in connection with a merger, division, sale of business, or incorporation of the business. We will give 30 days' notice, and you may terminate for that reason. You may not assign your position under these Terms without our prior written consent.
33. Severability, No Waiver, Entire Agreement
If any provision is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision is treated as replaced by the valid provision closest to its intent.
Our failure to exercise a right is not a waiver of it.
These Terms, the Privacy Policy, and the Location-Based Services Terms constitute the entire agreement between you and us about your use of the Service — without limiting mandatory consumer-protection law or any rights the app stores give you.
34. Governing Law and Disputes
These Terms and your use of the Service are governed by the laws of the Republic of Korea.
If a dispute arises we will try in good faith to resolve it. Failing that, proceedings shall be brought in the court having jurisdiction under the Korean Civil Procedure Act.
Sections 34.1 and 34.2 do not deprive you of the protection of mandatory consumer-protection law in your country of residence. Users in the EU/EEA and the UK may rely on their local consumer-protection rules and out-of-court dispute-resolution schemes.
Users in Korea may apply to the Korea Consumer Agency for dispute mediation, to the Personal Information Dispute Mediation Committee for personal-data disputes, and to the Korea Communications Commission for adjudication of personal location information disputes.
35. Additional Terms for Apple App Store Users
If you obtained the Service through the App Store:
These Terms are between you and us, not with Apple Inc. ("Apple").
We alone are responsible for the Service and its content.
Apple has no obligation whatsoever to furnish any maintenance or support for the Service.
If the Service fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
We, not Apple, are responsible for addressing claims relating to the Service, including product-liability claims, claims that the Service fails to conform to a legal requirement, and intellectual-property infringement claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.
You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
Supplementary Provisions
These Terms take effect on 2026-08-18.
These Terms are published in English and Korean. Where the two conflict, the Korean version prevails for users resident in the Republic of Korea, and this English version prevails for all other users.
