Cozysand Location-Based Services Terms

These terms are provided under Article 19 of the Republic of Korea's *Act on the Protection and Use of Location Information*, and govern the provision of location-based services using personal location information.

1. Purpose

These terms set out the rights, obligations, and responsibilities of Cozysand ("we", "us", or the "Company") and of the individual whose location information is processed ("you") in relation to the location-based services we provide.

2. Effect and Amendment

1. These terms take effect when you agree to them.
2. We may amend these terms to the extent permitted by applicable law.
3. We will give notice of any amendment, with its effective date, at least 14 days in advance (30 days where the amendment is unfavourable to you), in the app or by email.
4. If you do not accept an amendment, you may stop using the location-based services and withdraw your consent.

3. Supplementary Rules

Matters not provided for here are governed by applicable law and by our Terms of Service and Privacy Policy.

4. The Services and Their Price

1. We use your personal location information to provide the following:

1. Location-based services carry no separate charge; they are included in your plan (free or paid). What each plan includes is shown on the in-app subscription screen and in the store's product information. Any mobile data charges incurred are payable by you under your carrier's tariff.
2. We may change or discontinue any location-based service, with the advance notice described in Section 13 of the Terms of Service.

5. Use and Provision of Personal Location Information

1. Before using your personal location information to provide a location-based service, we set out these terms and obtain your consent.
2. We do not use your personal location information for any purpose other than providing the service, and do not provide it to a third party, without your consent.
3. We do not provide your personal location information to any third party for that third party's own purposes, and we do not sell it. The only parties that process it are the processors listed in Section 10, acting on our behalf.
4. We process personal location information only to the minimum extent necessary to provide the service, and do not separately retain it afterwards, except for the confirmation data described in Section 8. Places you save yourself, and their coordinates, are kept until you delete them.

6. Your Rights

1. You may withdraw your consent to the collection, use, or provision of your personal location information, in whole or in part, at any time — by turning off the location permission in your device settings, or by turning off location features in the app.
2. You may at any time require us to temporarily suspend the collection, use, or provision of your personal location information. We will not refuse, and we maintain the technical means to do so.
3. You may require us to provide or give you access to the following, and to correct any error in it. We will not refuse without justified cause.
• the record of the fact that your location information was collected, used, or provided
• the reason for and content of any provision of your personal location information to a third party under a statutory requirement
4. You can read the records in Section 6.3 yourself in the app at Settings → Location Use History, and you may also request them at support@cozysand.com, in which case we will act without delay.
5. If you withdraw consent in whole or in part, we will destroy the corresponding personal location information and confirmation data without delay — except for confirmation data relating to services already provided, which is retained under Section 8.
6. If you withdraw consent or require suspension, the location-based services will not be provided.

7. Legal Guardians and Protected Persons

1. We do not collect, use, or provide personal location information of children under 14, who cannot register for the Service (Terms of Service, Section 7).
2. Where the guardian of a person aged 8 or under, a person under adult guardianship, or a person with a severe mental disability registered under Korean law consents to the use or provision of personal location information for the protection of that person's life or body, that consent is treated as the person's own.
3. A guardian relying on Section 7.2 must prove that status in writing to support@cozysand.com, and may then exercise all of the rights in Section 6.

8. Retention of Records of Collection, Use, and Provision

1. Under Article 16(2) of the *Act on the Protection and Use of Location Information*, we automatically record and retain data confirming the collection, use, and provision of location information.
2. Each record contains the date and time, the purpose, and the processor to which processing was entrusted. The coordinates themselves are not recorded.
3. These records are retained for six months and then destroyed.
4. You may read them by the means described in Section 6.4.

9. Provision to Third Parties and Notification

1. We do not provide your personal location information to third parties.
2. If we later introduce a service that provides your personal location information to a third party at your direction, we will tell you who will receive it and why, and obtain separate consent beforehand.
3. In that case we would notify you of the recipient, the date and time, and the purpose each time it is provided — or, if you ask in advance, in batches covering up to 30 days.

We entrust the processing of location information as follows. Each processor handles it only as needed for the entrusted task.

1. If we cause you loss by breaching Articles 15 to 26 of the *Act on the Protection and Use of Location Information*, you may claim damages, and we are not relieved of liability unless we prove absence of intent or negligence.
2. If you cause us loss by breaching these terms, we may claim damages from you.

13. Exemptions

1. We are not responsible for failing to provide a location-based service because of: force majeure; deliberate interference by a third party with whom we have a service agreement; causes attributable to you; or any other cause not involving our intent or negligence.
2. Positioning by GPS, cell towers, and Wi-Fi inherently carries error, and an indoor floor is an estimate derived from barometric pressure and map data. We do not warrant the accuracy or completeness of location information, and you must not act on location, floor, or place information without verifying it (Terms of Service, Sections 20 and 23).
3. To the extent permitted by applicable law, we are not liable for loss arising from information you obtained through a location-based service — except where caused by our wilful misconduct or gross negligence.

14. Dispute Resolution

1. If we cannot resolve a location-information dispute with you by agreement, we may apply to the Korea Communications Commission for adjudication under Article 28 of the Act.
2. You may apply to the Korea Communications Commission for adjudication, or to the Personal Information Dispute Mediation Committee for mediation under the Personal Information Protection Act.

Supplementary Provision

These terms take effect on 2026-08-18. Where this English version conflicts with the Korean version, the Korean version prevails for users resident in the Republic of Korea.
